1. Acceptance of Terms

These Terms and Conditions ("Terms") govern your access to and use of EchoVaani ("Service"), operated by the EchoVaani team. By registering for an account you confirm that you are at least 13 years of age and accept these Terms.

2. Description of Service

EchoVaani allows users to create AI-powered "personas" — digital representations of people — by uploading voice samples, photographs, personality descriptions, and memories. These personas can then engage in text and voice conversations.

3. Responsible Use of AI Personas

By using EchoVaani, you agree that:

• You will only create personas of people for whom you have consent — your own loved ones, yourself, or with explicit permission from the subject (or their estate).
• You will not create personas intended to impersonate, deceive, harass, or defame any living person without their consent.
• You will not use the service to generate content that is illegal, abusive, sexually explicit, or harmful.
• You understand that AI-generated responses are not real communications from the person represented — they are AI approximations.
• You will not claim that AI-generated content is authentic communication from a deceased person in any legal, medical, or financial context.

4. Voice Cloning Consent

When you upload voice samples to EchoVaani:

• You confirm you have the legal right to use and submit those recordings.
• You confirm you have the consent of the person whose voice is recorded, or that you are their authorised next of kin.
• You grant EchoVaani a limited licence to process those recordings solely to provide the voice cloning feature.

5. Subscriptions & Payments

EchoVaani offers both a free trial and paid subscription tiers (Memory, Family). Paid plans are processed by Whop. By subscribing you agree to Whop's Terms of Service.

• Free trial: limited to 3 sessions of 6 turns each. No payment required.
• Paid plans: billed monthly or annually as selected. Cancel any time through Whop.
• Refunds: we offer a 7-day refund window from first payment. Contact support@echovaani.life.

6. Intellectual Property

You retain ownership of all content you upload (photographs, voice recordings, memories). You grant EchoVaani a non-exclusive licence to store and process this content solely to provide the Service to you.

EchoVaani's software, branding, and platform are the intellectual property of EchoVaani and may not be copied or reproduced without permission.

7. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms.

8. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind. AI responses may be inaccurate, unexpected, or emotionally sensitive. EchoVaani is not a mental health service. If you are experiencing grief or mental health difficulties, please seek professional support.

9. Limitation of Liability

To the fullest extent permitted by law, EchoVaani shall not be liable for any indirect, incidental, special, or consequential damages arising from use of the Service, including but not limited to emotional distress, data loss, or service interruptions.

10. Termination

We reserve the right to suspend or terminate accounts that violate these Terms. You may delete your account at any time by contacting support@echovaani.life.

11. Changes to Terms

We may update these Terms from time to time. We will notify you by email of material changes. Continued use after the effective date constitutes acceptance.

12. Governing Law

These Terms are governed by the laws of India. Any disputes shall be resolved in the courts of India.
